Terms and Conditions
1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of our software application and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Definitions
"We", "Us", "Our", or "Company" refers to Trackself.io.
"You", "Your", or "User" refers to the individual or entity accessing or using the Service.
"Software" refers to our desktop application and any related components.
"License" refers to the right to use the Software under these Terms.
"Subscription" refers to the recurring payment arrangement for continued access to the Software and updates.
3. License and Subscription
3.1 License Grant
Subject to your compliance with these Terms and payment of applicable fees, we grant you a non-exclusive, non-transferable license to use the Software for the duration of your Subscription period and thereafter as specified in section 3.3.
3.2 License Types
Individual License: Grants one named user the right to use the Software.
Team License: Grants a specified number of users within your organization the right to use the Software. Pricing varies based on team size.
3.3 License Duration and Updates
While your Subscription is active: You will have access to all updates, new features, and improvements to the Software.
If your Subscription expires or is terminated: You may continue to use the version of the Software that was available on the last day of your Subscription indefinitely, but you will not receive updates, new features, or technical support.
3.4 Subscription Renewal
Billing: Subscriptions are billed on an annual basis.
Renewal: Subscriptions will automatically renew unless canceled before the renewal date.
Notifications: You will be notified of upcoming renewals in advance.
4. Premium Features
4.1 Third-Party Integrations
Premium features include integrations with third-party software, including but not limited to Jira. These integrations are subject to the terms and conditions of the respective third-party providers.
4.2 Trademark Acknowledgment
Jira is a trademark of Atlassian. All other trademarks, service marks, and trade names used in the Service are the property of their respective owners.
5. Trial and Refund Policy
5.1 Trial Period
Free Trial: When you sign up, we create a Subscription but delay the first payment for fourteen (14) calendar days (the "Trial Period").
No Charge During Trial: You may use the Software free of charge during the Trial Period.
Cancellation: If you cancel at any time before the Trial Period ends, the Subscription will be closed and no payment will be taken.
Automatic Billing: Unless cancelled, the first subscription fee will be charged automatically at the end of the Trial Period, and your paid Subscription term will begin.
Refunds: Once the first payment has been processed, the refund rules in Section 5.2 apply.
5.2 Refund Eligibility
Refund Window: You may request a full refund within 14 days of your first payment.
Refund Process: Refund requests must be submitted in writing to support@trackself.io.
Payment Method: Refunds will be processed using the original payment method.
5.3 Refund Exclusions
Post-Trial Refunds: Refunds are not available after the 14-day Trial Period has expired.
Renewal Refunds: Refunds are not available for renewal payments. You will receive renewal notifications at least 7 days before your subscription renews, giving you time to cancel if desired.
Partial Refunds: Partial refunds for unused subscription time are not provided.
6. User Responsibilities
6.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
6.2 Acceptable Use
Prohibited Uses: You agree not to:
- Use the Software for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the Software or its related systems
- Reverse engineer, decompile, or disassemble the Software
- Share your license credentials with unauthorized users
- Exceed the number of users permitted under your license type
7. Intellectual Property
7.1 Ownership
The Software, including all intellectual property rights therein, is and will remain the property of the Company. These Terms do not grant you any rights to use our trademarks, logos, domain names, or other brand features.
7.2 Feedback
If you provide feedback or suggestions about the Software, we may use this feedback without any obligation to you.
8. Privacy Policy
Our Privacy Policy, available at https://www.trackself.io/privacy-faq, describes how we collect, use, and share information about you when you use our Software. By using the Software, you consent to the collection and use of information as detailed in our Privacy Policy.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SOFTWARE.
10. Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
11. Termination
11.1 Termination by You
You may terminate your Subscription at any time by canceling through your account settings or by contacting customer support. Except for cancellations made during the 14-day Trial Period (Section 5.1), no refunds will be provided for any unused portion of your Subscription period once a payment has been processed.
11.2 Termination by Us
We may terminate or suspend your access to the Software immediately, without prior notice or liability, for any reason, including if you breach these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website or through the Software. Your continued use of the Software after such modifications will constitute your acknowledgment of the modified Terms.
